Public Records & Government Filings

8.1Public Availability of Filings

Certain Personal Data submitted through the Services (such as names of organizers or registered agents) may become part of Public Records once filed with governmental authorities (e.g., Secretaries of State). FormYourCorp does not control the use, disclosure, or retention of Personal Data once it enters the public domain.

8.2Beneficial Ownership Information (BOI) Disclaimer

While FormYourCorp may collect beneficial ownership data to facilitate specific services, the collection of this data does not constitute an agreement to file a BOI report with FinCEN on your behalf. Unless you have explicitly purchased a separate "BOI Filing Service," you acknowledge that you are solely responsible for filing your report.

Disclosure of Personal Data

9.1Service Providers & Legal Requirements

We may disclose Personal Data to:

  • Government Authorities: IRS, Secretaries of State, and FinCEN (where applicable).
  • Service Partners: Registered Agent providers and Banking/Fintech partners (e.g., Mercury, Wise) solely at your request.

9.2"Sale" of Data & Analytics (CPRA Notice)

FormYourCorp does not sell your Personal Data for monetary value. However, the use of third-party analytics (like Microsoft Clarity) may constitute "sharing" or "targeted advertising" under certain US state laws.

Global Privacy Control (GPC): We automatically honor valid GPC signals from your browser where required by applicable law, treating them as a request to opt-out of "sale/sharing."

Cookies, Analytics & Technical Consent

10.1Use of Cookies

We use cookies, web beacons, and pixels to operate the Platform, secure your login, and analyze usage.

10.2Session Replay & Interaction Recording

To improve usability and debug technical issues, we use third-party "session replay" tools, specifically PostHog and Microsoft Clarity. By accessing the Services, you expressly consent to the collection, recording, and storage of your interactions with the Platform (including clicks, scrolls, mouse movements, and keystrokes in non-sensitive fields) by these providers. We use these tools to help diagnose issues and improve usability, and we configure them to mask or exclude sensitive fields (such as payment details and government ID fields) where feasible.

10.3Microsoft Clarity & Advertising Disclosure

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. For more information, visit the Microsoft Privacy Statement.

10.4Digital Markets Act (DMA) & Google Consent Mode v2

We use Google Consent Mode v2 to ensure Google tags behave according to your consent choices collected via our CMP. Where you deny consent for a category, Google tags are configured not to read/write storage for that category and may operate in a restricted, cookieless measurement mode. We map your banner choices to the following granular consent signals:

  • ad_storage: Enables storage (such as cookies) related to advertising.
  • ad_user_data: Sets consent for sending user data to Google for advertising purposes.
  • ad_personalization: Sets consent for personalized advertising (remarketing).
  • analytics_storage: Enables storage (such as cookies) related to analytics.

Behavior Without Consent: If you deny consent, these signals are set to "denied." Instead, Google services may receive restricted cookieless signals (sometimes called 'pings') to communicate consent state and support aggregated measurement and conversion modeling. These signals are not used to enable cookie-based tracking for the denied category.

10.5IAB Transparency & Consent Framework (TCF v2.3) & Management

We participate in the IAB Europe TCF v2.3 and utilize a compliant Consent Management Platform (Cookiebot) to generate a "TC String" that transparently signals your preferences (Granted/Denied) to all downstream advertising vendors.

No Legitimate Interest: We do not rely on "Legitimate Interest" for advertising; we require explicit opt-in.

How to Withdraw or Change Consent: You may update your preferences or withdraw your consent at any time by clicking the "Cookie Settings" link (or the shield icon) located in the footer of our website. This action will immediately reopen the Consent Banner, allowing you to modify your choices. Your updated preferences will take effect immediately.

Data Retention

We retain Personal Data only for as long as necessary to fulfill the purposes described in this Policy, or as required by law (e.g., 7 years for tax records). When data is no longer needed, it is securely deleted or anonymized.

12.1Security Measures

The Services are operated from the United States. If you are located abroad, your data will be transferred to and processed in the U.S.

13.2Swiss-U.S. Data Privacy Framework

Where applicable, we rely on the Swiss–U.S. Data Privacy Framework for transfers to U.S. recipients that are certified under the Framework; otherwise, we use Standard Contractual Clauses (SCCs) and/or other lawful transfer safeguards.

14.1Europe (GDPR) & Switzerland (FADP)

If you are located in the EEA, UK, or Switzerland:

  • Controller: FormYourCorp acts as the Data Controller.
  • Your Rights: Access, Rectification, Erasure ("Right to be Forgotten"), Restriction, Portability, and Objection.

14.2United States (Unified State Rights)

Residents of California (CCPA/CPRA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), and Utah (UCPA) have the right to:

  • Know & Access: Confirm processing and access your data.
  • Delete & Correct: Request deletion or correction of inaccurate data.
  • Opt-Out: Opt-out of the "Sale" or "Sharing" of data for targeted advertising (see Section 9.2).
  • Limit Sensitive Data: Limit the use of sensitive personal information.
  • Non-Discrimination: We will not discriminate against you for exercising these rights.

14.3Canada (PIPEDA Compliance)

For users in Canada, we comply with the Personal Information Protection and Electronic Documents Act (PIPEDA).

15.2Right to Appeal (U.S. Residents)

If we decline your request, you may appeal within 30 days by emailing privacy@formyourcorp.com with the subject "Privacy Appeal." We will provide a written explanation of our decision.
