This Copyright Notice & Intellectual Property Policy (the "Policy") governs the ownership and permitted use of all content made available through the FormYourCorp website (formyourcorp.com) and platform (collectively, the "Services").

This Policy supplements and forms part of the Terms & Conditions and Privacy Policy. In the event of any inconsistency, the Terms & Conditions shall control.

All content, materials, and intellectual property displayed on or made available through the Services, including but not limited to text, graphics, logos, trademarks, service marks, trade names, designs, layouts, software, source code, functionality, interfaces, documentation, and compilations (collectively, the "Content"), are owned by or licensed to SANARK DIGITAL CORP, trading as FormYourCorp, and are protected by United States and international copyright, trademark, and other intellectual property laws.

All rights not expressly granted are reserved.

Permitted Use & Restrictions

Subject to your compliance with the Terms & Conditions, FormYourCorp grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Content solely for your personal or internal business use in connection with the Services.

2.1 License Restrictions

This limited license does not permit you to:

  • Copy, reproduce, distribute, republish, transmit, display, perform, modify, adapt, translate, or create derivative works from any Content;
  • Use any Content for commercial purposes unrelated to the Services;
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices;
  • Use any automated means, including bots, scrapers, or crawlers, to access or extract Content.

Prohibited Uses

Any unauthorized use of the Content, including but not limited to copying, reproduction, distribution, republication, modification, public display, or exploitation of the Content without prior written consent from FormYourCorp, constitutes a violation of applicable intellectual property laws and a material breach of the Terms & Conditions.

FormYourCorp reserves the right to take any action it deems appropriate in response to unauthorized use, including suspension or termination of access, enforcement of intellectual property rights, and pursuit of legal remedies.

Trademarks

The FormYourCorp name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of SANARK DIGITAL CORP or its licensors. You may not use such marks without prior written permission. All other names, logos, product and service names, designs, and slogans appearing on the website are the property of their respective owners and are used for identification purposes only.

User-Submitted Content

If you submit any content, materials, or information to FormYourCorp through the website or Services, you represent and warrant that you own or have the necessary rights to such content and that your submission does not infringe the rights of any third party.

To the extent applicable, you grant FormYourCorp a worldwide, non-exclusive, royalty-free license (sublicensable to our service providers) to use, reproduce, modify, and display such content solely as necessary to:

  1. Provide, operate, and maintain the Services;
  2. Comply with legal or regulatory obligations;
  3. Detect and prevent fraud or security breaches; and
  4. Internally improve and troubleshoot the Services.

Copyright Infringement & DMCA Notices

FormYourCorp respects the intellectual property rights of others and expects users to do the same. We comply with the provisions of the Digital Millennium Copyright Act (DMCA).

6.1 Filing a DMCA Takedown Notice

If you believe that any Content infringes your copyright, you may submit a written notice of claimed infringement to our Designated Agent at the contact information below. Your notice must include:

  1. Identification of the copyrighted work claimed to have been infringed;
  2. Identification of the allegedly infringing material and its location (URL);
  3. Your contact information (name, address, email, and phone number);
  4. A statement that you have a good faith belief that the use is not authorized;
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf;
  6. Your physical or electronic signature.

6.2 Counter-Notice Procedure

If you believe the material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice. A counter-notice must include:

  1. Identification of the removed material and its prior location;
  2. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification;
  3. Your name, address, phone number, and email;
  4. A statement consenting to the jurisdiction of the federal court in your district (or, if outside the U.S., to a federal court in Delaware) and that you will accept service of process from the complaining party;
  5. Your physical or electronic signature.

If we receive a valid counter-notice, we may forward it to the original complainant and restore the content within 10-14 business days, unless the complainant notifies us that they have filed a legal action to restrain the infringing activity.

Enforcement & Repeat Infringers

FormYourCorp reserves all rights to enforce its intellectual property rights to the fullest extent permitted by law, including the right to seek injunctive relief, damages, and attorneys' fees.

Repeat Infringer Policy: We may, in appropriate circumstances and at our discretion, suspend or terminate accounts of users who are repeat infringers. Failure by FormYourCorp to enforce any right or provision of this Policy shall not constitute a waiver of such right.

Governing Law

This Policy shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles, except that matters relating to copyright registration, infringement, and DMCA procedures shall be governed by United States federal law.
